Terms & Conditions

It is a condition of us allowing you to use our studio as a client, that you agree to our terms and conditions. If you do not agree to our terms and conditions, you should not use our studio. By ticking the accept box, you acknowledge and agree that you have read and accept these terms and conditions and understand that in ticking the accept box you are entering into a binding agreement with us.

WE WILL: If you sign the Move& terms and conditions, provided to you at the time of buying a package or membership, we will: (a) provide the Services to you in accordance with these terms and conditions, and (b) grant you access to the Studio to receive the Services and access the facilities made available at the Studio.

OUR RIGHTS: Acting reasonably, we reserve the right to refuse entry to or eject you from the Studio if you breach a term of these terms and conditions.


You must:

(a) comply with our Studio rules and health and safety requirements, as amended from time to time; (b) comply with any relevant laws; (c) respect other clients and our trainers, including not causing offence or injury to those people or causing damage to their property; (d) cease participating if injured, in discomfort or illness; (e) comply with our instructors’ instructions at all times


From time to time, it may be out of our control that a session may be cancelled by us. This will not result in any loss of package credits or account deductions.

Cancellation by you: (a) If you wish to cancel your attendance at a class, you need to do this via your Momence log in. (b) If your Cancellation is less than 6 hours before the scheduled class start time, the session will be deducted from your package/membership. (c) If you cancel at least 6 hours before the scheduled Session start time, the Session will not be deducted from your package/membership.

For cancellations with an unlimited membership. If your Cancellation is less than 6 hours before the scheduled class start time, we may charge you $5 for each cancellation within 6 hours. This $5 will be deducted from your linked Stripe account.

Missing a class or failing to attend. If you fail to attend a class that you are booked in, the session will be deducted from your package/membership. If you fail to attend and are on an unlimited membership, you will be charged $10. This $10 will be deducted from your linked Stripe account.

We do understand, that at times things pop up that are unavoidable. If you have late cancelled or failed to attend a class for a reason of illness, unprecedented event or other extenuating circumstance, at your early convenience please send an email to hello@moveand.com.au and if deemed appropriate we will reverse any late cancellation or failed to attend fees.


Transferring a package or membership to another individual is not allowed. If illness or injury is preventing you from attending and you need to transfer your membership please contact hello@moveand.com.au and we will do our best to assist you.


Fortnight memberships have a minimum 8 weeks (4 fortnights) autopay schedule via the credit card stored in your Momence account which is connected to our secure payment system (Stripe). After eight (8) weeks, the membership will automatically continue on a fortnightly basis unless you make contact with the studio by emailing hello@moveand.com.au requesting that you wish to discontinue your membership. We require two (2) weeks’ notice to process all changes to memberships. We cannot provide refunds under any circumstances since direct debit is made by a third party, Stripe.

Memberships are subject to price changes. 4 weeks’ notice will be provided for any price increases.

It is your responsibility to ensure there are sufficient funds available in your account to cover the fortnightly direct debit. If a direct debit is declined due to insufficient funds the transaction will fail which requires additional administration and yields additional bank costs payable by you. Stripe is the third party used to process transactions and is unable to absorb these costs and applies an $11.90 fee for these failed transactions. This fee is debited seven (7) days after the failed payment.


After eight (8) weeks, memberships may be suspended via a written request (to hello@moveand.com.au) for a minimum of seven (7) days and a maximum of ten (10) weeks. We require two weeks’ notification to put memberships on pause. Suspensions are limited to a maximum of ten (10) weeks per year. Suspensions must be made in seven (7) day increments and can only be done after an initial eight (8) week period. Move and cannot pro-rata day usage. Any group sessions attended during the time that membership is suspended require the individual to purchase sessions.

Your membership will be billed showing Move and.

If direct debit contracts do not suit your needs we suggest purchasing a bulk class package, which may provide you more flexibility with bookings.


Move& do not offer extensions, refunds or transfers on any of our products or services. All our services have expiry dates. Please note the expiry date of your service as extensions are only provided in limited circumstances i.e. injury or illness. Any unused classes will be forfeited.


It is the responsibility of the client to make their own class booking. Move& takes no responsibility for forgotten or missed appointments. We will endeavour to provide a reminder to the client as a courtesy only. Please enable email/SMS notifications for reminders to be sent directly to you.

It is expected that if you have put yourself on the waitlist, you will follow the guidelines, as above, for cancelling a session. Waitlisting yourself means that you have planned to come to a class, it the class waitlist no longer suits you please cancel yourself off the waitlist. If you remain on the waitlist past the 6-hour cancellation window, you will be expected to attend that class, if a spot becomes available.

We have the above rules, as with smaller class sizes we want to enable as many people to attend their preferred class as possible. Cancelling prior to 6 hours and ensuring the waitlist is accurate allows us to contact people to attend the class as soon as possible.


The terms and conditions of our third-party biller Stripe form a binding component of your membership agreement. You can view them via Stripe’s website under https://stripe.com/en-au/ssa

Our policies are put in place to ensure we run a smooth and operational clinic for you to enjoy. By booking and attending classes you have noted the above policies which you agree to. If you do not agree with these our cancellation policies, you will not be able to attend classes.
